Juniper Glen North vs. Highland  Ridge

Part One - The developer (Woodhill Homes) named the association Juniper Glen North in all the association documents.  He did not incorporate an association under that name.

Part Two - Probably as a marketing decision, the developer re-named the association Highland Ridge.  He did not make a change to the documents which continued to refer to the association as Juniper Glen North.

Part Three - The developer turned over an association called Highland Ridge, but legally named Juniper Glen North.  Bill Friedman discovered the error and contacted the developer and his attorney. They said, “Whoops, the association was never incorporated". This means that the association was left without a means to protect itself and to file an annual report with the IRS.  Along with the task of incorporating, we also had to decide under which name to incorporate and how to go about doing it. Legally we were Juniper Glenn North but we had been operating as Highland Ridge.

Part Four - The developer’s lawyer gave the HOA documents to file, which may or may not have been the appropriate ones.  Bill Friedman turned these over to the association’s attorney. 

Part Five - The HOA attorney has discussed two alternative strategies for moving forward.   One would be to do a name change from Juniper Glen North to Highland Ridge.  He suggested that this takes written permission from each owner.  The second would be to keep the Juniper Glen North name for legal purposes and use Highland Ridge as a DBA.
